Terms and Conditions of Sale for Christian-Bailey Agencies Pty Ltd.

These terms and conditions (“Agreement”) constitute a legally binding agreement between you (“Customer”) and Christian-Bailey Agencies Pty Ltd (“Company”) governing the sales of all stocked items (“Products”). By placing an order with the Company, the Customer agrees to be bound by the terms and conditions stated herein. If you do not agree with any part of this Agreement, please refrain from placing an order.

1. Orders: a. Customers can place orders in store or by contacting our sales team directly. b. All orders are subject to acceptance by the Company. c. Prices and availability of Products are subject to change without notice. d. The Company reserves the right to refuse or cancel any order at its discretion.
2. Pricing and Payment: a. The prices displayed in store or quoted by our sales team are inclusive of applicable taxes and other relevant fees. b. In some cases, where stated by the sales person/s, freight will be added as an additional cost to the Customer once the item has arrived on Island. c. The Company accepts payment by cash, credit card, and for account customers only, wire transfer, or other agreed-upon methods. d. Payment must be made in full before the delivery of the Products.
3. Delivery: a. The Company will make reasonable efforts to deliver the Products promptly and in agreed-upon quantities. b. Delivery dates provided are estimates and may be subject to change. The Company shall not be liable for any delays or for any resulting damages. c. Risk of loss or damage to the Products passes to the Customer upon delivery. d. The Customer must inspect the Products upon receipt and report any discrepancies or damages to the Company within 48 hours.
4. Returns and Refunds: a. The Customer may return the Products within 14 days of receipt, subject to the Company’s approval. b. The Products must be in their original condition and packaging. c. Returned Products are subject to inspection, and a restocking fee may apply. d. Refunds will be issued within a reasonable time frame after the Company receives the returned Products.
5. Warranty and Liability: a. The Company makes no representation or warranty regarding the suitability, performance, or quality of the Products beyond the manufacturer’s warranty, if applicable. b. The Company shall not be liable for any indirect, incidental, or consequential damages arising out of the sale, use, or inability to use the Products. c. The total liability of the Company, whether arising from contract, tort, or otherwise, shall be limited to the purchase price of the Products under dispute.
6. Intellectual Property: a. All intellectual property rights related to the Products, including trademarks, copyrights, and patents, shall remain with the respective owners. b. Customers shall not use any intellectual property associated with the Company or the Products without obtaining the necessary permissions or licenses.
7. Privacy and Data Protection: a. The Company will handle personal information in accordance with applicable data protection laws and its Privacy Policy. b. The Customer agrees to the collection, use, storage, and processing of their personal information as outlined in the Company’s Privacy Policy.
8. Governing Law and Jurisdiction: a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located. b. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts in the same jurisdiction.
9. Entire Agreement: This Agreement constitutes the entire understanding between the Customer and the Company and supersedes any prior agreements, discussions, or representations, whether written or oral.

By placing an order with the Company, the Customer acknowledges having read, understood, and agreed to these Terms and Conditions of Sale.
